Co-existence measures and legal aspects

Since no GM plants are being commercially grown in Italy, co-existence is not yet a topic of great importance. Nevertheless, co-existence regulations are being implemented on the national and regional level.

Legal framework

The federal law 28/1/2005 defines the minimum co-existence measures which farmers must take to segregate GM, conventional and organic crops. Producers of GM crops in Italy must also abide by the co-existence requirements of local regions and autonomous provinces. The deadline for finalising these regional co-existence plans is July 28th, 2006. Only after the Federal Ministry of Agriculture has agreed to these plans will it be possible to commercially produce GM crops.

Liability for economic damages

No system of liability for economic losses due to unintentional admixture with GMOs exists in Italy at this point.
